Coolcore® Retains U.S. Patent 9,121,642 in Activation Patent Lawsuit

PORTSMOUTH, N.H. (Jan. 11, 2017) – Coolcore, the global leader in chemical-free cooling fabrics, today announced that the United States Patent and Trademark Office reaffirmed the novelty of its method of cooling an object with a fabric as described in US Patent No. 9,121,642 (the “`642 Patent”). The USPTO resoundingly rejected a competitor’s attempt to invalidate the `642 Patent; as a result, all claims originally granted remain in full effect. 

The `642 Patent covers a method of cooling an object with a fabric using the steps of wetting the fabric, wringing out excess liquid and snapping or waving the fabric to activate moisture control through it. Coolcore’s fabric becomes cool when activated by liquid and remains cool for an extended period of time thereafter without supplemental cooling chemicals. An Ex Parte Reexamination filed by the competitor on Feb.19, 2016, alleged that the method described in the `642 Patent was invalid in view of a number of references the competitor contended described Coolcore’s method. The USPTO rejected that effort after considering Coolcore’s arguments in reply. The Reexamination effectively ended on Nov. 30, 2016, when the USPTO rendered its decision, confirming the patentability of all claims and terminating the reexamination.
