A rather entertaining and enlightening discussion revolving around ski helmet use is kicking up on the RSN (Resort Sports Network) website. One particularly enlightened fellow had this to say most recently: "Everyone is talking about personal rights, that's bullsh#@t. We are guests on private property or leased property. If a ski area requires helmets, you have the right to not ski there. The real problem is that too many people refuse to take responsibility for their own actions. The result is a lawsuit. Yeah, there are hungry lawyers out there, but they need to have clients first. And before that there needs to be an incentive to sue. The bottom line is that juries (our peers) have awarded obscene amounts of money to people who won't take responsibility; creating the litigious society we now live in. It's "free" money; well it's not, and it has costs associated with it. If you get injured because you don't wear a helmet or seat belts, your insurance pays the bill, maybe you sue the mountain etc. Because the stairs has snow on them, insurance pays the bill. Insurance companies will not lose money; they just make ALL the insureds pay more. In the end we all pay more because a few are unwilling to take personal responsibility."
